Apple may lose its pinch-to-zoom patent, thanks to a review currently being conducted by the US Patent and Trademark Office (USPTO), which gave a preliminary ruling that the patent should not have been given to the Cupertino, California-based company.

Apple may lose its pinch-to-zoom patent, thanks to a review currently being conducted by the US Patent and Trademark Office (USPTO), which gave a preliminary ruling that the patent should not have been given to the Cupertino, California-based company.

 
The patent, along with five others, plays a key role in Apple's lawsuit against Samsung and could help Samsung evade paying damages for using that technology on its mobile devices.
 
The reason for the preliminary rejection of the patent is because the USPTO has discovered that the 21 methodologies Apple claimed in the patent had already been awarded to previous applicants, a fact it was not aware of in 2010 when it initially approved the application.

Apple will likely appeal against the preliminary ruling, while Samsung is expected to use it to convince the courts to reduce the $1.05 billion payment it was ordered to make to Apple in August.
 
This is not the first time the iPhone maker's patents have been questioned. It previously came under fire from the USPTO in October when it put the patent for the so-called “rubber band” user interface effect under review. 
 
We may see further patents at the heart of the ongoing patent war lose their validity as they are exposed to more scrutiny in the coming months.
