Kodak: Hey Guys, Look At Me!
After declaring bankruptcy and losing its infringement case before the International Trade Commission, Kodak plans to continue its fight against Apple and Research in Motion. At this point, why not at least try?
Kodak issued a statement saying that the patent "has been upheld in previous litigation at the ITC and was affirmed by the US Patent and Trade Office in the face of two separate challenges.”
The problem, however, is that Kodak is arguing the patent entitles the company to revenues for any device that previews a digital picture. As the ITC ruled, that is not the case; the Kodak patent simply does not support such an expansive interpretation.
The company is currently drafting a reorganization plan detailing how it could emerge from bankruptcy proceedings to continue operations. This is the last phase of a Chapter 11 proceeding. As part of this plan, Kodak is auctioning off 1,100 digital imaging patents on August 8. The company hopes to raise several billion dollars which would help to rejuvenate the once proud company.
Which companies are likely going to bid against each other for these patents? Apple and Samsung. Great…
